Liability Waiver & Membership Agreement

This agreement is entered into by and between FEAR TRAINING LLC, its owner Markos Mosi, staff, trainers, and affiliates (hereinafter referred to as “FEAR”), and the undersigned individual (hereinafter referred to as “Member”). {Digital Signature}

By signing this agreement, the Member agrees to the following terms and conditions:

1. Assumption of Risk

I understand that participating in physical fitness activities at FEAR TRAINING LLC, including but not limited to weightlifting, cardiovascular training, high-intensity interval training, and use of gym equipment, carries inherent risks. I acknowledge that I am voluntarily engaging in these activities at my own risk and assume full responsibility for any and all injuries or damages, whether due to the condition of the equipment, facilities, other participants, or my own actions.

I further understand and agree that FEAR, its staff, coaches, and owner Markos Mosi are not liable for any injury, illness, accident, or death that may occur while on premises or participating in any activity, including incidents resulting from any alleged negligence.

2. Medical Clearance

I certify that I have consulted with my physician or primary healthcare provider and am physically able to participate in fitness training and use of gym equipment. If I am pregnant or become pregnant, I agree to consult my physician to ensure that participation in physical activities at FEAR is safe for me.

3. Equipment & Facility Usage

I understand that gym equipment may fail or malfunction. I acknowledge that FEAR is not responsible for any injuries or damages caused by equipment failure or improper use. I agree to use the facility and all equipment as instructed and to report any equipment issues immediately to staff.

4. Damage to Property

I agree to take full responsibility for any damage to FEAR property, whether accidental or intentional, caused by myself or any guest I bring. I will be held financially responsible for the full cost of repair or replacement at the current market value.

5. Membership Cancellation & No Refund Policy

• A 30-day written notice is required for all membership cancellations.

• If notice is not given, I acknowledge and agree that I am responsible for payment of the next billing cycle.

• All payments are non-refundable once processed. No exceptions.

6. Code of Conduct

FEAR is committed to providing a safe, respectful, and motivating environment for all members and staff. I agree to:

• Respect fellow members and trainers

• Follow gym rules and instructions provided by staff

• Refrain from any form of harassment, disrespect, or negative behavior, including but not limited to slander, verbal abuse, or inappropriate conduct

FEAR reserves the right to revoke or cancel my membership without refund in the event of:

• Disrespect toward staff or other members

• Damage to property

• Publicly speaking negatively or defaming the business in any way

7. Release of Liability

By signing this agreement, I release, waive, discharge, and covenant not to sue FEAR TRAINING LLC, its staff, trainers, affiliates, and owner Markos Mosi from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained while on premises or participating in any activity related to FEAR.

8. Media Release (Optional)

I give permission to FEAR to use photos and/or videos taken of me during training sessions for marketing and promotional purposes on social media, website, and related platforms.

9. Acknowledgment & Agreement

I have read, understood, and agree to abide by the terms of this waiver and membership agreement. I am signing this voluntarily and acknowledge that this is a legally binding contract.
